Florida Criminal Defense Attorney Defends Man Charged with Strangling Girlfriend - No Conviction, No Jail Time!
April 2 /PRNewswire/ -- Despite being charged with two felonies each punishable by up to five years in prison, a North Fort Myers man was released with probation and an order to get counseling. After the man retained Musca Law for his defense, his attorney successfully negotiated a plea agreement whereby the man avoided jail time despite having been charged with two Third Degree Felonies.
In this case, the client was arrested and charged after a domestic violence-related incident. An officer was sent to a residence in North Fort Myers in response to a report of a domestic disturbance. Upon his arrival, the officer discovered the client, who was allegedly highly intoxicated, along with his live-in girlfriend, his girlfriend's adult daughter, and the daughter's boyfriend. According to the police report, after drinking all day the client abruptly and without warning lunged at his girlfriend and began to choke her. Her daughter then grabbed a beer bottle and struck the client twice in the head. The client then allegedly began to choke the daughter until the daughter's boyfriend pulled the client away from her. In his report, the officer noted that both victims had red marks on their necks. The client was arrested and charged with two counts of Felony Battery – Domestic Battery by Strangulation. These charges were each potentially punishable by five years' jail time.
The client retained Criminal Defense Attorney John Musca to represent him in this matter. After negotiations with the prosecutor's office, an attorney from Musca Law was able to get the prosecutor to reduce the charges to Domestic Violence Battery (1st Degree Misdemeanors). The conviction was withheld and instead the client received one year of county probation, along with the standard domestic violence conditions. The client was also required to complete 12 weeks of alcohol classes and Alcoholics Anonymous.
