Mr. Merkatz had been arrested along with two other fellow locksmiths for using a name similar to another larger competitor; a name he maintains was legally registered under Florida law. "This case was a CIVIL matter that should have been handled in a Civil Court," Merkatz said. "Every day of the week a company comes out with a product or service, and another company changes it slightly and sells or advertises it. No one has EVER been arrested for that."
As this book was written, the author made his best effort to show how his life was unnecessarily turned upside down because of "cracks" in the United States' legal system. "Things can quickly get out of hand," says Merkatz, "and the only option you have is to dig your way out with crippling, ever-mounting legal fees. Every day you turn on the news someone is being released from jail for a crime that they were 'Wrongly Convicted' of."
The book is NOT only a book on his story; he actually made this book an asset to anyone interested in the law. Some chapters in the book discuss why people actually plead GUILTY to crimes they did not commit, how the bail bond system works, the process of removing convictions from personal records, how to get out of a traffic ticket if you are pulled over by the police, and much more information pertaining to the legal system. The book also contains a legal glossary of common legal terms.
Merkatz said in one of his latest radio talk show interviews, that state laws should to be revised to reimburse criminally charged victims who are found NOT GUILTY by a trial, or whose charges are dismissed. "In a CIVIL case, the winner can ask for court costs and reasonable attorney's fees," Merkatz said. He stated that even when you WIN at a trial you still LOSE. States NEVER remove the Criminal Charges from your record, if they are dismissed, or you are found NOT guilty. The charges remain on the record and risks ruining the reputation of those found not guilty. His hope is that this new book will educate the public on how the criminal justice system "REALLY WORKS."
A great deal of attention has been on this case and the new book release, as videos online have received over 200,000 views in less than four months. David Merkatz has currently been booked to appear as a guest on over 15 radio talk shows, from Florida to Canada, including Kate Delaney and has scheduled upcoming TV interviews. The book is expected to generate record sales based on the number of inquiries received to date.
