On April 16, 2015, the Equal Employment Opportunity Commission ("EEOC") issued a long-awaited proposed regulation ("Proposed Regulation") with respect to employer-sponsored wellness programs and the Americans with Disabilities Act ("ADA"). While not yet final, the Proposed Regulation provides importance guidance on the extent to which employers may use incentives to encourage employees to participate in wellness programs that include disability-related inquiries and/or medical examinations.
