PHILADELPHIA, May 14, 2014 /PRNewswire/ -- Mr. Murray, a 59 year old childcare worker and father, was injured on November 1, 2011 when he was involved in a motor vehicle accident. Mr. Murray testified that he suffered numerous injuries as a result of the accident, including a partial tear to his left rotator cuff, a lumbar spine sprain and strain and a contusion to his right knee.

Firm founder Leonard K. Hill submitted a pre-litigation policy limits demand to the responsible party's insurance carrier on Mr. Murray's behalf. The policy limits demand was accepted and they resolved that claim. Upon resolution of the third party claim, Leonard K. Hill of Hill & Associates, P.C., on Mr. Murray's behalf, submitted a policy limits demand to his carrier, Progressive Specialty Insurance Company, requesting payment of the additional $50,000 in underinsured motorist coverage available to Mr. Murray. Progressive refused to tender the policy and the case was set for trial in front of the Honorable Mary Collins.
During trial, Mr. Murray testified that he suffered a contusion to his right knee, a lumbar spine strain and a partial tear to his left rotator cuff. He further testified that after five months of medical attention, including physical therapy, the right knee and lumbar spine injuries had been properly treated and were no longer symptomatic, however, his left shoulder continued to cause him occasional pain and discomfort.
The trial lasted two days and after two hours of deliberation the jury returned a $133,000 verdict in favor of Mr. Murray. The verdict was molded to the $50,000 policy limit on a post-verdict motion.
