Hill & Associates Wins $534,000 Verdict for Ankle Fracture
PHILADELPHIA, Dec. 21, 2016 /PRNewswire/ -- Hill & Associates, P.C. is pleased to announce a $534,000.00 verdict for Plaintiff, Bernadette Tanner. Bernadette Tanner v. Autozone Stores, LLC, Philadelphia Court of Common Pleas, November Term 2014, No. 2343.
Hill & Associates, P.C., led by attorneys Susan B. Ayres and Leonard K. Hill, represented Forty-five year old Bernadette Tanner for an injury claim arising from a February 17, 2014, slip and fall, against Autozone Stores, LLC.
Ms. Tanner, who works full-time as a home health agency scheduler, testified that she was injured when she slipped and fell on an ice and snow covered sidewalk in front of Autozone. She was transported by ambulance to the emergency room where she was diagnosed with a trimalleolar fracture, with comminution and dislocation.
During Trial, Ms. Tanner testified that in the emergency room she was splinted, given pain medication, and told not to bear any weight on her leg. She was discharged and instructed to follow up with a specialist. One week later, Ms. Tanner underwent open reduction internal fixation of the fracture, requiring a plate and multiple screws. Follow up visits revealed ongoing swelling and discomfort, and the need for a CAM boot. Ms. Tanner underwent months of physical therapy; however, she testified that she has ongoing issues with swelling, pain, strength, and mobility. She also has significant scarring in her left ankle.
The defense argued at Trial that Ms. Tanner was comparatively negligent for walking on a sidewalk that she saw was snow and ice covered. The defense also argued that Ms. Tanner had made a good recovery from her injury.
The Trial before the Honorable Daniel J. Anders lasted three days, including jury selection and deliberation. After two hours of deliberation, the jury returned a verdict of $534,000.00. No comparative fault against Ms. Tanner was found. Since then, the Court has ordered additional delay damages of $19,763.66.
After Trial, Ms. Ayres commented that she believes the jury truly appreciated the impact this injury was going to have on Ms. Tanner for the rest of her life.
