BIRMINGHAM, Ala., March 17, 2017 /PRNewswire/ -- The following statement is being issued by Tilghman & Company, P.C., regarding Drew's All Natural Food Class Action Settlement.
If you purchased certain Drew's All-Natural Salad Dressings and Quick Marinades, you may be entitled to a cash refund and other benefits from a class action settlement.
What is this about?
A proposed class action settlement has been reached concerning Drew's LLC's salad dressings and quick marinades. The lawsuit, known as Tovar v. Drew's LLC, No. 16-L-313, filed in St. Clair County, Illinois, claims that certain Drew's products falsely claimed that the products were "all natural." Drew's stands by its advertising and denies it did anything wrong. Nonetheless, the parties have agreed to settle this matter, and you may be a class member.
Who is a class member?
You may be a class member if you purchased the following flavors of Drew's salad dressings and/or marinades after June 15, 2011: Chipotle Ranch, Creamy Buttermilk Ranch, Greek Olive, Honey Mustard, Lemon Tahini Goddess, Poppy Seed, Raspberry, Roasted Garlic & Peppercorn, Romano Caesar, Rosemary Balsamic, Sesame Orange, Shiitake Ginger, Smoked Tomato, Soy Ginger, Thai Sesame Lime and Thousand Island.
What will I receive?
Drew's will establish a common cash fund in the amount of $200,000.00 from which it will pay valid claims. Class members who fill out the Claim Form and who do not have valid proof of purchase may recover $.50/product purchased, up to a maximum of 3 products/$1.50 per household. Class members who fill out the Claim Form and who have valid proof of purchase may recover $.50/product for each product purchased, up to a maximum of 20 products/$10.00 per household. In addition to the $200,000 cash fund, Drew's shall make available $275,000.00 worth of $3 coupons, for a total of 91,667 coupons. Any Class member submitting a Claim Form shall also be entitled to one coupon, which will expire nine months after the date of issuance. Each such coupon can be used only to purchase a 6-bottle case of Drew's salad dressing and marinade products from Drew's website. To receive these benefits, you must submit a claim form by July 15, 2017.
What are my rights?
If you don't want to be bound by the decisions of the Court concerning this settlement, you must request to be excluded in a writing postmarked by May 1, 2017. If you exclude yourself, you can't get money from this settlement. You may object to this settlement by sending an objection postmarked by May 1, 2017. Detailed instructions for excluding yourself or objecting are found on the website identified below. If you do nothing you will not receive a payment and you will be bound by the decision of the court regarding these claims, including certain releases of Drew's.
Before money is paid, the Court will hold a fairness hearing at 9:00 a.m. on May 16, 2017, in the St. Clair County, Illinois Circuit Court, #10 Public Square, Bellville, IL, in the Hon. Judge Randy Kelly's Courtroom to determine the fairness, adequacy, and reasonableness of the settlement, to consider whether to approve the settlement, and to consider a request by Class Counsel for payment of attorneys' fees and costs and class representative incentive awards. The motion for attorneys' fees and costs and plaintiff incentive awards will be posted on the website after they are filed. You may appear at the hearing, but you don't have to. If the Court does not approve the settlement, or if the settlement is overturned on appeal, no cash payments will be made.
