Kennedy Hodges LLP files Overtime Claim against Methodist Healthcare System for Alleged Wage Violations.
HOUSTON, May 20, 2014 /PRNewswire/ -- Kennedy Hodges, LLP – Houston-based employment law firm brings collective action lawsuit [3:14-cv-00160; Joy Corcione v. Methodist Hospital; United States District Court; Southern District of Texas, Galveston Division] against the Methodist Hospital system on behalf of plaintiff Joy Corcione and all other similarly situated nurses for alleged overtime wage violations under the Fair Labor Standards Act (FLSA).
The claim, brought against seven Houston area Methodist Hospitals and the Methodist Healthcare System contends that the Methodist Hospital has failed to properly compensate non-exempt employees. Court documents allege that Methodist automatically deducted 30 minutes for a meal break its employees' paychecks regardless of whether they take a break or are completely relieved of their job responsibilities.
The Plaintiff alleges that based on the law, the employee must be completely relieved of all duties for wages to be deducted for a meal break. However, the Plaintiff contends that it is virtually impossible to take a completely uninterrupted meal break as nurses are frequently interrupted to answer questions by patients and their families, assisting doctors, taking calls from other departments, and taking calls on their hospital-issued phones.
Methodist Hospital has confirmed in its statement to Ms. Corcione's attorney that any nurses that join this case will not be penalized as federal law strictly prohibits retaliation.
It is believed that over 5,000 employees have been affected by this violation nationwide and that the estimated damages can include any owed overtime plus liquidated damages. Wages can be attained for up to three years from the date of the violation.
