L. Patrick Mulligan & Associates, LLC Obtains Acquittal in Rape Case
Attorney L. Patrick Mulligan of Dayton criminal defense law firm L. Patrick Mulligan & Associates, LLC obtained a not guilty verdict in a case involving a 34-year-old man accused of sexually victimizing three young girls
DAYTON, Ohio, Oct. 4, 2016 /PRNewswire/ -- A Greenville, Ohio man who was accused of raping his girlfriend's three daughters, two of whom were under the age of 10, has been found not guilty of three counts of rape and three counts of gross sexual imposition. The man refused to accept a plea deal and was determined to prove his innocence in court alongside his attorney, Patrick Mulligan, of L. Patrick Mulligan & Associates, LLC. The jury deliberated for only two hours before returning their verdict.
"I've done trials all over. I'm always impressed with how serious the juries are when they analyze a case," said Mulligan. "We can only thank them for their time. It is the greatest system in the world and I know that a lot of people knock the jury system, but it is as good as anywhere in the world."
Mulligan stated that the testimony of the three alleged victims was "contaminated" due to multiple retellings by various people. "The number of times that these children were interviewed or spoken to by unprofessional people before they got to Dr. Roediger is truly amazing," he said. "From an investigative standpoint, this case was handled horribly."
The third day of the trial opened with the defendant taking the stand on his own behalf. He described his relationship with his girlfriend and her three daughters, firmly denying that he ever engaged in sexual conduct with the girls. The defense rested its case after his testimony.
The mother of the three girls was recalled as a witness to further describe her relationship with the defendant and to counter the testimony of her brother, who contradicted some of her testimony regarding her actions following disclosure of the alleged abuse. The alleged victims' uncle claimed that she coached the girls on what to say to the doctor before arriving at the hospital, and pointed out that she had accused their biological father of similar allegations in Pennsylvania.
Mr. Mulligan's impassioned closing statement asked the jury to consider whether they would bet a single paycheck on the evidence – "if the answer is 'No,' you haven't even come close to 'beyond reasonable doubt.'" The jury agreed.
Mr. Mulligan's client was relieved to have been able to prove his innocence and will finally be released from jail after more than a year. He faced a possible life sentence if found guilty.
"He has been absolutely confident in his position and never once wavered. Today he was rewarded for his convictions," Mulligan said after the trial.
