Medical malpractice verdict against Local Doctor in case filed and tried in the Circuit Court of Adair County, Missouri in Kirksville
KIRKSVILLE, Mo., May 15, 2015 /PRNewswire/ -- On August 22, 2009, Joyce Hurley of Novinger broke her left ankle and was taken to the emergency room at Northeast Regional Medical Center. There John Bailey, DO of Kirksville performed surgery to repair the ankle. Joyce's ankle fractures did not heal, and the fixation devices placed by Dr. Bailey failed. Corrective surgery was performed by Chris Main, DO, with Midwest Bone & Joint in Macon.
Joyce brought suit against Dr. Bailey claiming he failed to properly align and fixate her ankle fractures, causing the lack of healing and the need for corrective surgery. Joyce now has daily pain in her ankle and walks with a limp.
The case was tried before the Honorable Russell Steele beginning Monday, May 11, 2015. The jury returned its verdict late last night, finding Dr. Bailey was negligent and awarding Joyce monetary compensation of $263,428.47. The defendant, John Bailey, is a well-known local doctor who has also dabbled in politics - he recently ran - and was defeated - for state representative. This is believed to be only the 3rd medical malpractice plaintiff verdict in the history of Adair County.
