New York Workers' Compensation Lawyer Adnan Munawar Weighs-In On High-Profile Workers' Compensation Decision Involving Ex-NFLer
New York Workers' Compensation Lawyer Adnan Munawar, of Munawar & Andrews-Santillo, LLP comments after court grants workers' compensation eligibility to Tom Tupa, former NFL Punter.
NEW YORK, Sept. 9, 2014 /PRNewswire/ -- Tom Tupa, who played as a punter in the NFL for 18 seasons is eligible for workers' compensation, The New York Times reported (Court Rules for Punter on Injury, August 22, 2014). Maryland's highest Court ruled in an opinion by Judge John Eldridge in Pro-Football Inc., T/A The Washington Redskins v. Thomas J. Tupa, Jr. that the career-ending injury Mr. Tupa suffered while warming up for a 2005 preseason game made him eligible for workers' compensation benefits.

Mr. Tupa was warming up for a game when he landed awkwardly and needed medical treatment. The court rejected arguments that football injuries should not be considered accidental in light of the physical nature of the sport, and instead found that the injury happened in the course of Mr. Tupa's employment, which meant that Mr. Tupa's injury was compensable.
"It is encouraging to see a court standing up for the rights of workers and holding employers accountable," said Adnan Munawar, Partner at Munawar & Andrews-Santillo LLP. "People, including professional athletes, should be free to go to work and perform their duties without worrying about whether or not they will be compensated if they suffer an injury."
"Some might find it surprising that such a high-profile athlete would be eligible for workers' compensation, but the benefits are there to protect even NFL players. The real difference between Mr. Tupa and most people is that Mr. Tupa likely had ready access to an attorney and was prepared to stand up for his rights. Fortunately, anyone can afford an attorney to assist with a workers' compensation claim because you only ever pay a fee if your claim is successful. While the typical claim won't go to the state's highest court, claims are often rejected and people do frequently need to fight for the benefits they need and deserve. Having a strong advocate on your side can make all the difference and it is recommended that anyone who is considering filing for workers' compensation contact an attorney right away and find out the best possible course of action."
