No On Measure R: Lawsuit alleges Marin General Hospital Officials with Federal Violations
SAN RAFAEL, Calif., Oct. 2, 2014 /PRNewswire/ -- In a lawsuit filed in Marin Superior Court by a former top executive, Marin General Hospital officials are accused of violating Federal laws regarding patient privacy and insider self-referrals for profit.
The plaintiff, Dennis Mondragon, former Chief Operating Officer of PRIMA Medical Foundation claims he was fired by Lee Domanico, CEO, for disclosing to the elected Marin Health Care District Directors, and Marin General Hospital management about misuse of confidential patient information in violation of HIPAA, the Federal law protecting patient privacy. He also alleges his employer violated anti-kickback Federal statutes prohibiting mandatory self-referrals for hospitals and ancillary services, such as x-ray and laboratory services.
Marin General Hospital officials are campaigning for voter approval for a new thirty year lease for the publicly owned District Hospital while the lawsuit is pending. While there is active grass roots opposition to passage of Measure R, the private Marin General Hospital Corporation is prepared to spend a million dollars or more to get Measure R passed by the voters in November.
