The Department of Labor has released the Test for Unpaid Interns, which outlines when an intern is considered an employee and when an intern is part of an extended training environment in the "for-profit" sector.
Unpaid internships, while uncommon, are possible when the on-the-job training is similar to what would be received in an educational setting. The training and job experience must benefit the intern; the employer should get no immediate benefit from the intern's involvement. Unpaid interns cannot displace or replace paid employees, and therefore are not necessarily entitled to an offer of employment at the end of the arrangement. Unpaid interns must be aware of their wage less status prior to the start of the program.
Given these parameters, unpaid internships are not as popular with students and businesses alike, unless they offer a unique learning experience.
On the other hand, there are many reasons companies offer paid internship programs. From an output side, short-term internships allow businesses to accomplish immediate objectives by better managing the workflow at significantly lower labor costs. From an employment view, interns have been thoroughly tested in the work environment prior to job offer, they are far more likely to accept the job when offered, and they tend to stay with their internship companies for five or more years.
