Planet Bingo and Melange Computer Services Speak Out Regarding Involvement in Litigation with Video King
While neither Planet Bingo nor its sister company, Melange Computer Services, normally comment on pending litigation, they felt it was important to clarify their position in view of recent misleading information that was placed in the press.
PALM DESERT, Calif., Feb. 25, 2014 /PRNewswire/ -- Planet Bingo, LLC and Melange Computer Services, Inc. are involved in litigation with VKGS, LLC d/b/a Video King. While neither Planet Bingo nor its sister company, Melange Computer Services, normally comment on pending litigation, they felt it was important to clarify their position in view of recent misleading information that was placed in the press. Judge Clinton Canady, III of the Ingham County Circuit Court in Michigan made a ruling on a narrow issue. In 2006, Planet Bingo had bought the assets and stock of Melange Computer Services. Included within the purchase was a contract between Video King and Melange that was characterized by Video King as a "joint venture or partnership." The contract in question had a mutual confidentiality clause. The argument presented before the Court was whether or not by merely buying Melange Computer Services, Planet Bingo had committed a technical violation of the confidentiality agreement because they then had access to the contract itself. In making his ruling, Judge Canady stated, "There is no doubt that Planet Bingo got the information from Melange that was subject to the confidentiality agreement that Melange had with Video King. I will grant the motion on that limited basis only." However, Judge Canady also stated, "I'm not getting into whether or not Planet Bingo benefitted." The Court also indicated that it did not know whether or not any of the information that was received by Planet Bingo was confidential or whether an assignment of the contract may have been agreed to by VKGS.
