Preliminary Approval Granted In Lawsuit Involving Former Penn Central Railroad Rights of Way in Ohio
WARREN, Ohio, Feb. 26, 2015 /PRNewswire/ -- The Trumbull County Court of Common Pleas has granted preliminary approval to a proposed settlement in a class action lawsuit involving former Penn Central railroad Rights of Way in the state of Ohio. A Right of Way is the land over which the railroad operates. Under the proposed settlement, American Premier Underwriters — the name by which Penn Central is now known — will pay valid claims for landowners who own or owned land next to or under its former railroad Rights of Way in Ohio. The case is Maas v. Penn Central Corp., No. 99CV723.
Plaintiffs allege that Penn Central, a former railroad company, sold and leased interests in rights of way in which it no longer owned a property interest.
Who is Eligible?
Class Members are current or former owner of land in the State of Ohio next to or under railroad Rights of Way corridor on which Penn Central operated a railroad and that has not been used for railroad purposes since April 1, 1976. Individuals who excluded themselves from the class action in 2008 are not eligible for the settlement. How to Receive a Benefit
To receive a settlement benefit, you must file a valid Claim Form on for before designated deadline date. A copy of the Claim Form will be available on the settlement website if the settlement receives final approval and becomes effective.
Class Members also have the right to object to a portion or all of the proposed settlement. A fairness hearing is scheduled on April 30, 2015 in the Court of Common Pleas for Trumbull County, Ohio. Following final approval of the settlement and the settlement becoming effective, class members who have submitted a timely, valid claim will receive a cash benefit payment determined by the terms of the settlement.
