EXPERT ALERTS:
Employment Regulation's Shift From Federal to State/Local Authority
Susan Drenning
President
ComplyRight
Drenning is available to discuss historical data and insights on employment regulation's shift from federal to state and local authority, tied to Andrew Puzder's confirmation. The promised elimination or rollback of federal employment regulations seems a sure bet as President-elect Donald J. Trump begins working alongside a Republican majority on Capitol Hill, but before businesses bank any expected savings or efficiencies, they should consider what's already happening a little closer to home. Since 2009, with no movement at the federal level, 31 of 50 states raised their minimum wage requirements above $7.25. Paid sick leave laws already exist with varying requirements in five states, the District of Columbia and more than 10 cities. Businesses can also expect to see more turf wars, as some states have begun battling with cities regarding their legal authority to issue minimum wage and other requirements. Says Drenning: "Deregulation in theory is a positive for small businesses seeking to focus on business activities instead of administrative and human resource demands. However, as we've seen over the past eight years, re-regulation may be the unplanned result. Staying informed at the federal, state and local levels is a must in today's more complex compliance environment. The accelerating pace of state and local employment laws makes increased diligence a necessity."
ComplyRight is a 30-year old company that monitors regulatory activity and posting requirements for U.S. companies. They monitor 22,000+ local regulatory authorities and provide employee and tax compliance products and services through their family of brands. Denning is available for comments or for bylines. She is a human resources and employment compliance expert, with particular focus on very small businesses (under 50 employees). She is able to speak to industry-specific issues regarding HR and labor law topics such as FLSA/overtime, minimum wage, "bizarre" or new local regulations, and the shift over time from federal to state authority. She is based in Florida.

Small Businesses and Tax Filing
Rick Roddis
President
ComplyRight's Tax Solutions, eFile4Biz.com
Last year, the deadline for businesses to file employees' 1099s and W2s with the government was March 31. This year, it's Jan. 31 -- the same day those forms are due to employees themselves -- which means employers no longer have that two-month cushion to correct any mistakes employees catch -- and mistakes are quite common. Further, small businesses aren't fully aware of that new deadline. Of the 522 small-business owners ComplyRight asked in late October, 39% believed the W2 and 1099 filing deadline was after Jan. 31. Roddis can discuss how small businesses typically approach tax filing, as well as the deadline implications for small businesses as they file their tax forms this year: "Reporting information that doesn't match up with the 1099 filed by the business in the previous year may trigger an IRS audit. Many small businesses still treat tax form filing as a manual process, meaning they're filling out forms on a computer, lining them up with paper forms in a printer. Especially in the past five years, the demand for paper tax forms has declined, while cloud-based preparation and electronic filing continues to grow. Businesses are looking for a smarter and faster alternative to doing it on their own -- and outsourcing is it."

The Joy of Losing Your Job
Christina DeOliveira
Founder and President

"Losing a job, especially one that was a huge part of your life, is not easy. Our identities are often wrapped up in our work, our financial situations may be precarious, responsibility for our families can weigh heavily on our shoulders and we may be steeped in fears about our future. Thankfully, many of us get beyond the dreadful, dark days following losing a job. Getting to that point sometimes takes baby steps, and it can take some time to regain a sense of hope. It's my hope, then, that one day you will decide to write your own ending and say, 'Losing my job was the best thing that could have happened to me.'"
DeOliveira is an educator, author, speaker and high performance coach. She is the president and founder of Performance Continuum, a boutique consultancy passionate about a singular mission: helping our clients achieve a competitive advantage through their people. She offers coaching services, leadership assessment, and leadership development and training. And her story is unique -- this career in consulting reflects a mid-life renaissance following the elimination of her job after 24 years with the same company due to corporate downsizing. DeOliveira tells her own inspirational story of overcoming the loss of her job in her book, "The JOY of Losing Your Job." She founded Simply Christina, a personal development platform she uses to teach people how to overcome less-than-favorable life events, increase their confidence to tackle any challenge, live with passion and purpose by truly creating a life they love. She is also the founder and president of David's Gift, a scholarship foundation dedicated to memorializing the life of her beloved brother, David, and to which proceeds from the sale of her book are donated.
