On September 24, 2013, Realization filed a complaint in the Superior Court of Santa Clara County against Kapoor, Srivastav, Chandrasekaran, and Kendrit for misappropriation of Realization's trade secrets. The complaint asserts 11 causes of action, including misappropriation of trade secrets, breach of confidential information agreements, breach of the duty of loyalty, and defamation.
Kapoor, Srivastav, and Chandrasekaran were employees of Realization until 2013 when they resigned to form Kendrit, Inc., a consulting company offering consulting and support services in competition with Realization. The complaint alleges that the defendants misappropriated and still retain Realization's confidential, proprietary and trade secret information.
"While competition is healthy, unfair competition is not," Realization CEO Sanjeev Gupta said. "Realization has invested tens of millions of dollars in developing its products, customers and accounts. We will not allow anyone to compete unfairly by using our most valuable assets."
Realization is a software and consulting firm founded in 1999 as a spin-off from Thru-Put Technologies, a software company founded by Realization Chief Executive Officer Sanjeev Gupta in 1993 to provide software based on the Theory of Constraints for manufacturing planning and scheduling.
Realization is the largest provider of software and services based on the Theory of Constraints and Critical Chain Project Management. The company is represented in the lawsuit by Bergeson, LLP.
