Realtime Data LLC Challenges Validity of Oracle Database Patent
TYLER, Texas and PLANO, Texas, March 4, 2016 /PRNewswire/ -- Realtime Data LLC today announced that on February 29, 2016 it filed an inter partes review (IPR) petition with the United States Patent Trial and Appeal Board (PTAB) challenging the validity of Oracle International Corporation's U.S. Patent No. 8,832,142 (the "Oracle Patent").
This marks the first time that an IPR has been requested to review one of Oracle's patents.
The petition asserts that Oracle's Patent, titled "Query and Exadata Support for Hybrid Columnar Compressed Data" is invalid because the inventions claimed were known in the industry as early as a decade before Oracle filed for patent protection.
Previously, Oracle had petitioned for inter partes review of 5 of Realtime Data's patents after Realtime filed suit against Oracle for infringement of those patents.
"It is typical for many large companies to claim ownership and use technology they did not invent—if you want a feature, just add it, don't bother to worry about who may actually have invented it," said Realtime President, Jerry Padian.
"We believe strongly in the view that patents are property to be respected and defended like any other kind of property," added Padian.
"The rights of the small innovator need to be protected against infringement and, when necessary, large companies that use and sell technology they didn't invent need to be challenged."
"We know what we invented, and are confident in the strength of our patents and technology. Those who challenge our inventions must be ready to defend what they claim to have invented. The IPR process works both ways, and we look forward to the outcome of these proceedings."
