RegenLab Dismisses All Patent Infringement Claims Against Eclipse's Customers
RegenLab USA, LLC filed Notice of Voluntary Dismissal Without Prejudice in its patent infringement, Civil Action No. 1:17-cv-0384, which dismisses all patent infringement claims against Eclipse MedCorp, LLC's customers.
DALLAS, Dec. 11, 2018 /PRNewswire/ -- On November 29, 2018, RegenLab USA, LLC filed a Notice with the United States District Court for the Southern District of New York to dismiss its patent infringement claims against all of the remaining customers of Eclipse MedCorp, LLC.
In a corresponding press release from RegenLab USA, LLC, RegenLab stated that it "dismissed its suit against Eclipse's customers in order to focus on Eclipse."
RegenLab recently lost its patent infringement lawsuits in Germany; and, RegenLab lost a nearly identical preliminary patent infringement lawsuit in the European Union, which RegenLab was forced to appeal (appellate hearing pending).
Responding from Eclipse headquarters in the Dallas, TX metro area, Eclipse CEO, Tom O'Brien, stated, "We don't accept the reason they gave but regardless we are glad RegenLab decided to drop the suit against our customers. I suspect they realized it is a bad idea to sue potential customers. Such actions may be how they do things overseas but in America it has gone over like a lead balloon. RegenLab did not have any evidence that Eclipse or its customers violated RegenLab's patents. We see them as a group that is trying to become relevant in the US by seeking to litigate doctors and successful competitors. Anything less than that will not work in the US."
