TO: ALL PERSONS WHO PURCHASED THE PUBLICLY-TRADED SECURITIES OF THE GREAT ATLANTIC & PACIFIC TEA COMPANY, INC. ("A&P" OR THE "COMPANY") BETWEEN JULY 23, 2009 AND DECEMBER 10, 2010, INCLUSIVE (THE "CLASS PERIOD")
YOU ARE HEREBY NOTIFIED that pursuant to an Order of the United States District Court for the District of New Jersey, a hearing will be held on December 18, 2014, at 10:00 a.m., before the Honorable William J. Martini, at the Martin Luther King Building & United States Courthouse, Courtroom MLK 4B, 50 Walnut Street, Newark, New Jersey 07101, for the purpose of determining (1) whether the proposed Settlement of the Action for the sum of Nine Million Dollars ($9,000,000.00) in cash should be approved by the Court as fair, reasonable, and adequate; (2) whether, thereafter, this Action should be dismissed with prejudice against the Settling Defendants as set forth in the Settlement Agreement dated May 8, 2014; (3) whether the Plan of Distribution of settlement proceeds is fair, reasonable and adequate, and therefore should be approved; and (4) the reasonableness of the application of Lead Counsel for the payment of attorneys' fees and expenses, together with interest thereon, and payment to Lead Plaintiffs for their expenses incurred in representing the Class.
If you purchased A&P publicly-traded securities during the period July 23, 2009 through December 10, 2010, inclusive, your rights may be affected by this Action and the Settlement thereof.
