Russ Purvis Files Suit Against Buchanan County, Missouri and Advanced Correctional Healthcare for Failure to Provide Medical Care to an Inmate
Advanced Correctional Healthcare is facing a lawsuit for failure to provide medical care to an inmate. The suit alleges that the inmate suffered a skull fracture and partial paralysis when ACH failed to provide medical treatment.
KANSAS CITY, Mo., Sept. 4, 2015 /PRNewswire/ -- A lawsuit has been filed against Buchanan County, Missouri and Advanced Correctional Healthcare (ACH), as well as the Buchanan County Sheriff and other county employees and individual employees of ACH, seeking damages against the defendants for injuries suffered by an inmate, Tyler Fee. The suit alleges that Buchanan County, ACH and the other named defendants were negligent, and violated Mr. Fee's constitutional rights, by failing to provide medical treatment to Mr. Fee which caused him to suffer a skull fracture and partial paralysis.
Buchanan County contracts with ACH, to provide its inmates with medical treatment. The suit alleges that Buchanan County and ACH allegedly withheld necessary prescription medication from the inmate causing him to suffer a seizure and fall, resulting in a fracture of his skull. The suit further alleges that the skull fracture was not treated for six days, even though jail personnel and ACH employees were aware of the fact that the inmate had struck his head and began to bleed from the nose, sleep almost around the clock, slur his speech, drag his right leg, and lose use of his right arm and hand.
ACH, an Illinois based corporation, currently contracts to provide medical treatment to 40 county or municipal jails in Missouri and 245 jails in 17 states. This is not the first allegation of improper medical treatment by an ACH facility. Suits in Kentucky, Alabama and Georgia have alleged the same pattern and practice of ignoring and/or failing to provide inmates necessary treatment.
Attorney Russ Purvis of the Montee Law Firm filed the suit on behalf of the inmate. According to attorney Purvis: "The failure of ACH and Buchanan County to provide even the most basic medical care to inmates held in the Buchanan County Jail is not only unconstitutional, but unnecessarily caused serious injuries to Mr. Fee, and continues to pose a serious risk to the life of every inmate held in the Buchanan County Jail."
The case is styled: Tyler Fee v. Buchanan County, Missouri, et al., Case Number 15BU-CV02918. The matter is currently pending in the Circuit Court of Buchanan County, Missouri.
