NYS Governor Cuomo's Justice Center is treating the disabled as sub-humans and is violating their Civil Rights by denying 1,000,000 vulnerable NYS residents safe care and immediate 911 first responder medical and police services in most reported cases of abuse.
NY residential care facilities remain rampant with abuse and neglect since Gov. Cuomo took office and he has taken no significant actions to stop or prevent the staggering numbers of abuses and deaths occurring even following the 2011 NY Times "Abused & Used" award-winning investigative reporting series. The Justice Center is currently violating FOIL law by not releasing further extremely damming information and releasing statements to the media claiming they investigate all reported cases which is a lie. Dozens of JCF Foil requests reveal County 911 call centers and District Attorney's receiving zero calls from the Justice Center abuse hotline.
Abuse and neglect is a crime according to NYS Penal law 260.25, but most of these criminal cases never get to the police or go through the normal criminal justice system. The 911 call system was established nationwide for everyone, not to negate the disabled, this denies the disabled the same equal rights, privileges and protections of laws everyone else benefits from. This blatant discrimination is happening in NYS 50 years after Dr. Martin Luther King Jr. fought against such gross inequality. Most people with disabilities cannot march or fight for their own equal rights are being denied emergency 911 services when they are injured and victims of crimes by their caregivers. This discrimination must be stopped now.
The Justice Center Abuse hotline is not treating abuse or neglect of a disabled child or adult as a possible crime or an emergency; directing witnesses to report directly to them not to 911 call centers all across NYS http://www.justicecenter.ny.gov/resources/hotline/report-it-poster. Gov. Cuomo's Justice Center abuse hotline has been acknowledged on tape to be operating fraudulently according NYS Assembly leadership and Oversight & Investigation Chairman Andrew Hevesi- http://www.nydailynews.com/new-york/secret-tape-shames-queens-assemblyman-article-1.1814814. Deputy Secretary of Health Courtney Burke, whom oversees the Justice Center, on tape acknowledges providers are investigating themselves. NYS is literally aiding and abetting in the cover ups by giving providers all the time and ability to remove and destroy evidence and influence hired staff regarding crimes against our most vulnerable disabled.
