Virginia Attorney Michael J. Melkersen Set to Try First Case Nationwide Against Volkswagen in "Dieselgate" Scandal
FAIRFAX, Va., April 6, 2016 /PRNewswire/ -- The first trial Nationwide has been set against Volkswagen Group of America, Inc., for June 24, 2016, in connection with the scandal that has become known as "Dieselgate." The case brought by Virginia attorney Michael J. Melkersen on behalf of his client, Sarah Carter, alleges that Volkswagen committed fraud by selling Carter a 2013 VW Beetle TDI equipped with software designed to deceive emissions tests into concluding that the VW Beetle emitted EPA compliant emissions, when in fact, the actual emissions emitted were up to 10 to 40 times higher than EPA standards allow.
The Carter case is one of hundreds that have been filed across the Country seeking redress against Volkswagen for the at-issue fraud. Most of these cases, however, were filed in federal court as class action lawsuits, all of which have been consolidated in the United States District Court for the Northern District of California. Believing that he could obtain both a faster and more lucrative resolution for Carter by pursuing her case on an individual basis, Melkersen filed Carter's case in the Fairfax County General District Court, docket number GV15-027880-00. Volkswagen aggressively sought to thwart Melkersen's strategy by filing a Motion to Dismiss as well as a Motion to Stay the case, arguing that Carter's case should either be dismissed or postponed until the federal proceedings are concluded. Arguments on the motions occurred on March 28, 2016, before Judge Mitchell Mutnick, who denied both the Motion to Dismiss and the Motion to Stay. Melkersen responded to the ruling stating, "I look forward to obtaining justice for Ms. Carter in the first trial in the Country against Volkswagen for its reprehensible conduct. No corporation, no matter how large and powerful, is above the law."
