Virginia Landry Featured in OC Register Article Discussing Reportedly Flawed Blood Alcohol Tests
The Orange County Register featured DUI Defense Lawyer Virginia Landry in their front-page story explaining the admittedly flawed crime lab test that led to at least 20 apparent wrongful DUI allegations.
IRVINE, Calif., Nov. 8, 2013 /PRNewswire/ -- Just this week, officials with the Orange County Crime Lab admitted that one of their tests was flawed, resulting in an estimated hundreds of incorrect blood alcohol readings, including at least 20 cases where people were wrongfully accused of DUI. The Orange County Register's account of this admitted error features commentary from Orange County DUI Attorney Virginia Landry (Nov. 6, 2013, OC Register).
"This is a very serious procedural and regulatory violation," commented Landry. "Anyone convicted better seek qualified counsel."
The OC Register article claims that at least 20 people appear to have been unjustly accused of driving with a blood alcohol concentration of .08 percent or higher, the legal limit, and also explained that the Orange County District Attorney's office identified 900 individuals who were tested with the admittedly flawed blood alcohol testing device.
The director of the Orange County Crime Lab, Bruce Houlihan, was quoted in this article confessing that the error occurred due to failed calibration of a testing machine in late May. This calibration error caused the machine to be off by .003 percent. While not a huge margin of error, the oversight was enough to put some people just over the legal limit when they were actually just under this threshold.
Landry was also interviewed by two other Southern California reporters regarding this story. Eileen Frere, the Orange County Bureau Chief Reporter for KABC TV, interviewed Landry for a segment that is poised to run on KABC this evening and Mike Landa of KNX radio for a story that will run on AM1070.
